Question:

778 Mr. Durkan asked the Minister for Transport if points are applicable to the driver or the owner of a vehicle in the event of a driver being out of the country when his or her car exceeded the speed limit thereby incurring points; and if he will make a statement on the matter. [1579/03]

Where an alleged penalty point offence is detected and it has not been possible to immediately identify the driver, the relevant notice is sent to the registered owner. The notice provides that where the registered owner claims that he or she was not driving or otherwise using the vehicle at the time of the commission of the alleged offence, he or she must give to the Garda the name and address of the driver of the vehicle. On foot of receipt of this information from the registered owner, a notice will issue to the named driver, on whose licence record the points will be endorsed, either on payment of a fixed charge or a court conviction.

In the event that the registered owner does not identify another person as the driver, it is a matter for the registered owner to pay the relevant fixed charge or allow the matter to proceed to court.
