Question:

258 Mr. Hayes asked the Minister for Agriculture and Food when the balance of a REP scheme payment will issue to a person (details supplied) in County Tipperary. [5701/03]

All payments due to the person named have been paid. Following a compliance inspection on 19 October 2001, the person named was penalised 45% for non-compliance. The person named was advised of the penalties on 23 October 2001, and was offered the opportunity to appeal the penalties within ten days. No appeal was received and a further letter issued on 4 December 2001 offering the opportunity to appeal to the REPS appeals committee. No appeal has been received by the committee. The penalties and interest were deducted from the final REPS payment and a balancing amount issued on 24/1/2002 to the mandated bank.
