Question:

111 Mr. Perry asked the Minister for Agriculture and Food the position regarding the farm entitlements of a person (details supplied) in County Sligo under the Fischler proposals in view of the circumstances outlined in correspondence; if he will address the issues raised; and if he will make a statement on the matter. [9543/03]

As the Mid Term Review proposals are still under discussion it is not possible to provide a definitive assessment of the position of individual producers at this stage.

According to the Commission proposals, a person who sold his or her entire milk quota in the 2002-03 milk quota year would not have any entitlement to a dairy cow premium since the premium is to be based on the quota available on the holding on 31 March 2004. A person who received payment under the slaughter premium scheme in the reference period, would on that basis, have established an entitlement to payment under the proposals.

Question:

112 Mr. Perry asked the Minister for Agriculture and Food if he will waive the penalty applied on the REP scheme payment of a person (details supplied) in County Sligo in view of his medical condition, which required hospitalisation; and if he will make a statement on the matter. [9556/03]

This penalty has already been reviewed on appeal in my Department's local office. The outcome of that review was that the decision was upheld. In notifying the person named that his appeal had been unsuccessful, my Department advised him of his further right of appeal to the Agriculture Appeals Office, which is statutorily independent in its functions. It is open to him, if he takes his case to the appeals office, to put forward the information referred to in support of his appeal.
