Question:

229 Mr. Perry asked the Minister for Justice, Equality and Law Reform if he will intervene with the Land Registry on behalf of a person (details supplied) and have the application expedited; if he will make a favourable decision; and if he will make a statement on the matter. [10160/03]

Earlier the position in relation to this case was set out in my reply to Parliamentary Question No. 226, reference No. 10156/03. Dealing Number D2002SM006603X refers.

Applications under section 49, which require detailed examination of claims for registration as owners, can take some time to process due to their complicated nature. This matter is receiving attention in the Land Registry and will be completed as soon as possible.

230 Mr. Penrose asked the Minister for Justice, Equality and Law Reform if he will expedite an application for registration under section 49 on behalf of a person (details supplied) in County Westmeath; and if he will make a statement on the matter. [10247/03]

I am informed by the Registrar of Titles that this is an application for first registration which was lodged on 25 November 2002. Dealing No. D2002XS011609P refers. Queries issued to the lodging solicitor on 5 December 2002. The application cannot proceed until the queries raised are satisfactorily resolved.

These cases require examination of an applicant's entitlement to the property concerned. At present it is not possible to estimate a date of completion due to the complicated nature of such cases. This matter will receive further attention in the Land Registry on receipt of a satisfactory reply.

231 Mr. Penrose asked the Minister for Justice, Equality and Law Reform if he will take steps to ensure that an application by a person (details supplied) in County Westmeath is dealt with immediately; and if he will make a statement on the matter. [10248/03]

I am informed by the Registrar of Titles that the dealing number quoted by the Deputy refers to an application under section 49, acquisition of title by virtue of long possession, of the Registration of Titles Act 1964 which was lodged on 4 June 2002. Queries, which issued to the lodging solicitors on 10 July 2002, were replied to on 10 March 2003.

Applications under section 49 require detailed examination of claims for registration as owners. Due to their complicated nature the processing of such cases can take some time. The application is receiving attention and will be completed as soon as possible.

Question:

232 Mr. Ellis asked the Minister for Justice, Equality and Law Reform if the Land Registry will complete a dealing number for a person (details supplied) in County Leitrim. [10249/03]

I am informed by the Registrar of Titles that the applications referred to by the Deputy are as follows: an application for a transmission on death which was lodged on 25 October 2000 and an application for section 49, acquisition of title by virtue of long possession, of the Registration of Titles Act 1964 which was lodged on 23 February 2001. Dealing Nos. D2000WS009246C and D2001WS001504K refer.

Due to their complicated nature applications under section 49 can take some time to process. At present dealing No. D2000WS009246C is in the final stages of completion and will be completed within the next few weeks. Dealing No. D2001WS001504K is receiving attention in the Land Registry and will be completed as soon as possible.
