Bernard J. Durkan

Question:

119 Mr. Durkan asked the Minister for Justice, Equality and Law Reform when residency status will be awarded in the case of a person (details supplied) in County Kildare; and if he will make a statement on the matter. [13319/03]

An application for permission to remain in the State based on marriage to an Irish national was received from the person in question in September 2003. Applications of this type currently take approximately nine months to process. The application in question is, however, receiving attention. Following consideration of all the relevant information, the matter will be finalised.

Question:

120 Mr. McGuinness asked the Minister for Justice, Equality and Law Reform if the Ministerial Order under section 2(2) of the Local Government Act 1993 made in relation to a property at Leggettsrath, County Kilkenny, will be withdrawn in view of the fact that the alleged emergency of that time no longer exists; his views on whether the order is relevant at this point in time; if so, the reason therefor; and if he will make a statement on the matter. [13326/03]

As I indicated in my reply to Parliamentary Question No. 632 of 7 May 2003, the development envisaged at this site is currently the subject of litigation in the High Court and, as such, I am unable to make any comment on the matter referred to by the Deputy.
