Question:

247 Mr. N. O'Keeffe asked the Minister for Agriculture and Food the position regarding the milk quota appeal from a person (details supplied) in County Limerick. [15546/03]

The allocation of the balance of the Agenda 2000 milk quota to certain categories of small and medium scale milk producers has been completed and applicants have been notified of the outcome in their own cases. An application was submitted by the person named in relation to this quota. However, as the conditions of the scheme were not satisfied, an allocation was not made.

An appeals procedure exists for this scheme and the person named has submitted an appeal. The assessment of appeals will be based on recommendations from the milk quota appeals tribunal. Work on the assessment of the approximately 1,800 appeals arising from the scheme is expected to be completed shortly and at that stage each appellant will be notified of the outcome.

248 Mr. N. O'Keeffe asked the Minister for Agriculture and Food if he will consider an application under appeal by a person (details supplied) in County Cork for an additional milk quota under the seven million gallon scheme. [15547/03]

The allocation of the balance of the Agenda 2000 milk quota to certain categories of small and medium scale milk producers has been completed and applicants have been notified of the outcome in their own cases. The applicant was successful in meeting the qualifying conditions under the farm modernisation scheme category and an allocation was made to him.

An appeals procedure was introduced for this scheme whereby applicants who did not qualify under the conditions of the scheme or who felt that the allocation made in their case was incorrect, could appeal the decision to the milk quota appeals tribunal. The closing date for receipt of such appeals was 10 January 2003. There is no record of the person named having submitted an appeal before the closing date and it is not possible to accept appeals at this stage.
