Question:

602 Mr. Deasy asked the Minister for Transport if penalty points will be applied to the driver of a vehicle if another passenger has not used his or her seatbelt. [15210/03]

Drivers shall be liable to penalty points both in relation to the non-wearing of their own seatbelts and their responsibilities to passengers under 17 years, as required under the 1991 regulations.

603 Mr. Deasy asked the Minister for Transport if a person who is put off the road for not having insurance will also have penalty points placed on their licence. [15211/03]

Where a person is convicted of an offence under section 56 of the Road Traffic Act 1961 for using a vehicle in a public place without insurance and the court makes an order disqualifying him or her for holding a driving licence, that conviction shall not attract penalty points.
