66 Mr. Durkan asked the Tánaiste and Minister for Enterprise, Trade and Employment the period after which a Section 56 endorsement ceases to negatively affect a motorist insurance premium; and if she will make a statement on the matter. [18227/03]

The pricing and underwriting of insurance is a matter for individual insurance companies and EU law prevents Governments from intervening directly in relation to premium levels or in respect of what risks they are prepared to underwrite. Insurers generally make decisions about whether they are prepared to quote for a particular risk, and, if so, at what premium level, based on their underwriting experience of that risk in the market.

In their assessment of risks in individual cases, insurers may consider that the existence of an endorsement on a motor licence is an indication of a higher risk and consequently a higher premium may be applied by the insurer. It would be a matter for each individual insurer to review the matter in the light of subsequent experience in each case.
