Question:

198 Ms O'Sullivan asked the Minister for Education and Science the reason children of non-EU nationals who have lived here for more than five years and who have applied for third level places through the CAO system have to pay the non-EU level of fees; if he will review this; and if he will make a statement on the matter. [19152/03]

The rate of tuition fee charged by third level institutions to students who are not eligible under the free fees initiative, is a matter for each institution to determine. The classification of a student as an EU or non-EU applicant, is a matter for each institution to determine.

I understand that the Conference Heads of Irish Universities has established a working group to examine the issues surrounding the criteria for determining eligibility status with a view to establishing a uniform approach in the university sector.
