Question:

255 Aengus Ó Snodaigh asked the Minister for Justice, Equality and Law Reform the selection procedure in relation to the Garda Commissioner and Assistant Commissioner. [21581/03]

The power to appoint a Garda Commissioner is exclusively vested in the Government by virtue of section 6(2) of the Police Forces Amalgamation Act 1925. The procedure to select a Commissioner and the pool of persons considered is a matter for Government to determine, when the making of such an appointment is required.

The Garda Síochána (Promotion) (Amendment) Regulations 2001 – SI No. 392 of 2001 – govern promotion to the rank of Assistant Commissioner. Appointment to the rank of Assistant Commissioner is made by the Government on the recommendation of an interview board comprising the commissioner, who chairs the interview board, a Deputy Commissioner, a person nominated by the Top Level Appointment's Committee and a person nominated by the Civil Service Commission.
