378 Ms Burton asked the Minister for Health and Children the reason for the current practice of the Adoption Board in seeking affidavits from adopted people undertaking not to make contact with their original families; and the legal basis for these requirements and the other arrangements put in place by the Adoption Board to assist people who wish to trace their birth parent or parents. 389 Ms Burton asked the Minister for Health and Children his views on the fact that the adoption consultation process is being undermined by the Adoption Board changing its practice and procedures in anticipation of expected legislative outcome; and if he will make a statement on the matter. [23315/03]

I propose to take Questions Nos. 378 and 389 together.

The Adoption Board is an independent statutory body with responsibility for administration of the Adoption Acts 1952 to 1998. Among the services it provides are a search and reunion service for adopted people. Internal procedural arrangements in the performance of its functions are a matter for the Adoption Board. I am advised that the Adoption Board sought and obtained separate and independent legal advice on this service pending the introduction of specific legislation dealing with adoption information and post-adoption contact. I have passed the Deputy's questions to the Adoption Board's chief executive officer for appropriate attention.
