196 Mr. English asked the Minister for the Environment Heritage and Local Government if Ireland is currently being sued by the EU for not implementing the European ELV directive; if so, the amount this will cost the Exchequer; and if he will make a statement on the matter. [30580/03]

I propose to take Questions Nos. 196 and 197 together.

I refer to the reply to Questions Nos. 331 and 345 of 25 November 2003.

My Department has recently received notice of an application by the European Commission to the European Court of Justice ECJ to initiate proceedings against Ireland in relation to the partial transposition and non-implementation of Directive 2000/53/EC on end of life vehicles ELVs. As indicated in my reply of 25 November last, it is my intention to conclude the discussions with the relevant stakeholder groups as soon as possible with a view to full transposition and implementation of the directive requirements. I would be hopeful that the ECJ proceedings will be discontinued on notification of the necessary transposing regulations and the commencement of the relevant implementing measures.
