Vol. 30 No. 4

Juries Bill, 1945—Committee and Final Stages.

Sections 1 to 6 agreed to.
SECTION 7.
Question proposed: "That Section 7 stand part of the Bill."

I am afraid I misled the House on the last day in the statement that there was only one panel from which juries were drawn for lunacy and other cases. I find that those who spoke on that occasion, and who have more experience, of course, than I have, made the same mistake. That is not the position. If a jury is required in a lunacy matter, a panel of jurors is requisitioned for that purpose and is prepared from the jurors' book. A panel for the ordinary High Court jury cases would be prepared from the same book but would contain different names. I understand that juries are very rarely called in lunacy matters.

That is so.

I want to correct the statement I made on the last day, as I was under a misapprehension. Senator O'Dea and Senator Ryan, it seems, were also under the same misapprehension, so that there was some excuse for me.

I had intended to put down an amendment, as I was also under a misapprehension. I made inquiries, however, and found I was wrong.
