EU Instruments: Motion.

I move:

That the proposal that Seanad Éireann, in accordance with the terms of Article 29.5.2 of the Constitution, approves the terms of the following five instruments (given legal effect by the Customs and Excise (Mutual Assistance) Act, 2001 (No. 2 of 2001)), copies of which were laid before Seanad Éireann on 12 June 2001:

Convention, drawn up on the basis of Article K.3 of the Treaty on European Union, on the use of Information Technology for Customs Purposes, done at Brussels on 26 July 1995;

Convention, drawn up on the basis of Article K.3 of the Treaty on European Union, on Mutual Assistance and Cooperation between Customs Administrations done at Brussels on 18 December 1997;

Protocol, drawn up on the basis of Article K.3 of the Treaty on European Union, on the interpretation, by way of preliminary rulings by the Court of Justice of the European Communities of the Convention on the use of Information Technology for Customs Purposes done at Brussels on 29 November 1996;

Protocol, drawn up on the basis of Article K.3 of the Treaty on European Union, on the scope of the Laundering of Proceeds in the Convention on the use of Information Technology for Customs Purposes and the inclusion of the registration number of the means of transport in the Convention done at Brussels on 12 March 1999, and

Agreement on provisional application between certain Member States of the European Union of the Convention, drawn up on the basis of Article K.3 of the Treaty on European Union, on the use of Information Technology for Customs purposes done at Brussels on 26 July 1995; be referred to the Joint Committee on Finance and the Public Service, in accordance with paragraph (1)(a)(iv) of the Orders of Reference of that Committee, which shall, not later than 29 June 2001, send a message to the Seanad in the manner prescribed in Standing Order 67, and Standing Order 69(2) shall accordingly apply.
