SECTION 70.

I move amendment No. 179:

In page 41, subsection (2), line 6, before "hire-purchase" to insert "a". This is a drafting amendment.

Amendment agreed to.

Amendments Nos. 180 and 180a are related and may be discussed together, Is that agreed? Agreed.

I move amendment No. 180:

In page 41, subsection (3), line 10, to delete "where the hirer deals as consumer".

These amendments are proposed for the purpose of clarity. As the purpose of the Bill is to deal with consumer transactions only, the phrases "where the hirer deals as consumer", and, ", in any other case," should be deleted. Otherwise the inference may be made in argument at some future time that because these phrases appear in the Bill, there is the intention within the Bill to cover areas where the hirer does not deal as a consumer. These proposals were made to us by the Incorporated Law Society of Ireland which considered them necessary. In this respect, the committee will note that I have attempted where possible to identify the sources of proposed amendments.

Amendment agreed to.

I move amendment No. 180a:

In page 41, subsection (3), lines 10 and 11, to delete ", in any case,".

Amendment agreed to.
