I move amendment No. 27:
In page 20, subsection (5), line 15, to delete "1996.'." and substitute the following:
"1996.
(3) Nothing in this paragraph or any other provision of this Act shall prejudice the provisions of section 20 of the Irish Takeover Panel Act, 1996.'.".
This is a further refinement of the amendment being made by this section to the privilege aspect of the Defamation Act, 1961. It will remove legal uncertainty in the previous text where in two tests; that of acting in bad faith and acting with malice, could be applied to the panel's actions.
