SECTION 19.

I move amendment No. 20:

In page 23, subsection (1), line 40, after "present" to insert "and voting".

This is a straightforward amendment. Subsection (1) provides, inter alia, that a member may be expelled from a credit union if a resolution for his expulsion is passed by at least two thirds of the members at the general meeting called for the purpose of proposing his expulsion. For example, if 100 credit union members attended such a meeting, a minimum of 67 members must vote in favour of the resolution for it to be passed.

However, the standard provision in other sections is that the passage of a resolution is determined by the numbers present and voting. If this formula operated in the example of a meeting with 100 credit union members present where only 90 voted, the resolution for expulsion would be passed if 60 of the 100 persons present voted in favour.

If 100 people are present and only 70 vote, is the result legal if two thirds of the 70 vote in favour of the resolution?
