The Bill takes the choice of specimen away from the person and gives it to the Garda. This is required to close off loopholes which have shown up in court cases. A further anomaly may still exist where a person does not refuse to give a specimen but a doctor is unwilling to take one on medical grounds. I hope to bring forward some appropriate amendments to take account of that point on Report Stage.
