I move amendment No. 169:
In page 31, lines 3 to 6, to delete subsection (1) and substitute the following:
‘person' shall include an individual, a body corporate and an unincorporated body of persons (including a political party) and a body corporate and any subsidiary thereof shall be deemed to be one person;
‘political party' means a political party registered in the Register of Political Parties in accordance with section 25 of the Act of 1992 as a party organised to contest a Dáil election or a European election or a local election or all or any combination of such elections.".
The amendment is a replication of the definitions in the other sections. Given the volume of work, these were not included initially. The amendment repeats the definition of person, political party, etc.
I move amendment No. 171:
In page 31, subsection (2)(b)(ii), line 35, to delete "otherwise" and substitute "moneys provided by an institution of the European Communities or other intergovernmental organisation to which the State is a party".
I move amendment No. 172:
In page 31, subsection (2)(b)(ii), line 38, to delete "1994" and substitute "1996".

In page 31, subsection (2)(b)(ii), line 39, to delete "1992" and substitute "1996".
I move amendment No. 174:
In page 31, subsection (2)(b)(ii), line 41, to delete "the outgoing" and substitute "a former or the retiring".
Section 38(2)(b) provides that any payment made to a candidate at a presidential election from public funds by virtue of being the outgoing President shall not be deemed to be a donation. It is a technical drafting amendment to bring reference to the outgoing President into line with the wording of Article 12.4.4th of the Constitution which refers to a former or retiring President.
