Select Committee on Legislation and Security debate -
Wednesday, 12 Jan 1994

SECTION 6.

Amendment No. 11 has already been discussed with amendment No. 5a.

That is correct and we accepted the Minister's undertaking yesterday that he will not look at the situation as the Landlord and Tenant Act relates to residential tenancies. That is a pity. Since this amendment relates to residential tenancies I understand that he could not accept it. However, I am delighted to hear that the Minister will, before Report Stage, look at the possibility of having an opt out supervised by the court as in England. I take his point that perhaps it would be wrong to allow all of the running to the court. Perhaps the Legislature will have to decide what is fair and reasonable and stipulate that in an amendment. I will not be pressing the amendment given the Minister's stance.

Amendment Nos. 11 and 12 not moved.
Section 6 agreed to.
Title agreed to.
Report of Select Committee.

I propose the following draft report:

The Select Committee has considered the Landlord and Tenant (Amendment) Bill and has made amendments thereto. The Bill, as amended, is reported to the Dáil.

Is that agreed?

Report agreed to.

Ordered to report to the Dáil accordingly.

As we have completed Committee Stage, I wish to thank you, Chairman, for your effective chairmanship of this committee both yesterday and today. I thank all Members of the committee from the different parties, and also Deputy Gregory who was present yesterday, for participating in what I think has been a constructive discussion and a necessary teasing out of the provisions in the Bill. We have done our work quickly and I hope we will be able to take Report Stage in the Dáil in February, hopefully after the Minister and Government have been able to make a decision on the residential area as well. I thank the Minister for his very constructive approach to discussions we had on Committee Stage, showing the degree of flexibility that is always welcome and desirable on Committee Stage of any Bill.

Thank you Deputy. The Committee Stage of the Criminal Justice (No. 3) Bill, 1993 will commence on Tuesday, 18 January in room G2 at 11 a.m. with a private briefing sesssion.

For Dublin Deputies such as myself there is no particular difficulty but the meetings on the Bill we have completed were originally scheduled for the morning and we changed them to 2 p.m. I do not have a strong view on this but I wonder whether to facilitate a number of Deputies from outside Dublin we should start the meeting at 2 p.m. on Tuesday rather than 11.30, or if not at least leave it to the discretion of the convenors of the different parties to agree the time.

Is 2 p.m. agreed? Agreed. The meeting will begin with a private session at 2 p.m. and the public session will start at 2.30 p.m.

Is there a meeting on Wednesday?

There will be a meeting on Wednesday morning, if necessary.

The Select Committee adjourned at 12.35 p.m. until Tuesday, 18 January at 2 p.m.
