SECTION 6.

Question proposed: "That section 6 stand part of the Bill."

Under subsection (2) if the court is satisfied that the amount that might be realised at the time the confiscation order is made is less than the amount the court assesses to be the value of his proceeds of drug trafficking, the amount to be recovered in the defendant's case under the confiscation order shall be the amount appearing to the court to be the amount that might be so realised. If he realises more, can the balance be carried forward for possible future collection? If the court values a farm at £100,000 and it is subsequently sold for £150,000, can the court review its decision and can the balance of the realisable asset be carried foward for future collection?

The point Deputy Mitchell is raising is covered in section 14; if the court discovers that the amount of assets is greater it can make an order under section 14.
