Select Committee on Legislation and Security debate -
Wednesday, 5 Apr 1995

SECTION 9.

Question: "That section 9 be deleted from the Bill" put and agreed to.
TITLE.

Amendments Nos. 41, 42 and 43 are related and may be discussed together.

These are purely drafting amendments necessary to reflect the Bill as published.

I move amendment No. 41:

In page 2, line 5, to delete "AND EXTEND".

I accept the amendment although I do not believe it.

Amendment agreed to.

I move amendment No. 42:

In page 2, lines 7 and 8, to delete "AND CERTAIN OTHER PROPERTY" and substitute "IN RESPECT OF DANGERS EXISTING ON SUCH PREMISES".

Will the Minister explain why he is doing this? Is it irrelevant to the occupier and apply only to the entrant?

I am told that "premises" covers everything; it is all-embracing.

Amendment agreed to.

I move amendment No. 43:

In page 2, lines 9 and 10, to delete "OR IN SUCH PREMISES OR OTHER PROPERTY" and substitute "SUCH PREMISES".

Amendment agreed to.
Title, as amended, agreed to.

It is important for Members of the committee and for the Minister that there is a period before Report Stage. I realise there is an automatic gap of about two weeks which is more than adequate. As a general principle, however, it is preferable that there is an adequate time span, especially with legislation such as this Bill which has many implications. One wishes to consider what the Minister has said about the sections. I take it that Report Stage will not be taken tomorrow?

There will be a break?

The Whips will agree on that.

The Deputy made an important point. Obviously, it is primarily a matter for the Whips. However, I endorse the recommendation that there be a sufficient period of time between the various Stages and I am pleased Deputy Woods made that point. With regard to this legislation, Report Stage will probably be taken after the Easter recess at the earliest. The convenor and Whips will keep us informed of developments.

There should also be a reasonable time between the publication of amendments the Minister might consider on Report Stage and taking Report Stage.

We made that point with regard to amendments on Committee Stage. It is valuable for the Opposition to have a reasonable time to consider amendments put forward by a Minister.

I am sure the Minister will assist where possible.

Having said that, we are anxious to take the Bill as soon as is reasonable after the recess. This is not intended to delay the Bill; we should press on with it because it is important legislation.

Report of Select Committee.

I propose the following draft report:

The Select Committee has considered the Bill and has made amendments thereto. The Bill, as amended, is reported to the Dáil.

Is that agreed?

Report agreed to.

Ordered to report to the Dáil accordingly.

The Select Committee adjourned at 5.45 p.m. sin die.
