SECTION 295.

I move amendment No. 94 :

To delete lines 36 to 39 and substitute :

" he shall be liable, on conviction on indictment, to imprisonment for a term not exceeding 2 years or to a fine not exceeding £500 or to both or, on summary conviction, to imprisonment for a term not exceeding 6 months or to a fine not exceeding £100 or to both."

Amendment agreed to.
Question proposed: "That Section 295, as amended, stand part of the Bill.

Is there any change in this section ?

Section 295 is new. It is one of those sections which was recommended by the Bankruptcy Committee but about which nothing was done until now. I think the reasons for the recommendation are still valid and that is why we are introducing this section.

If there is good reason for getting rid of this expression " misdemeanour " in paragraph (o) at page 154 is there any reason why it should remain in this section. Line 36 reads—"shall be guilty of a misdemeanour." What makes it less objectionable there ?

It has been removed by amendment No. 94.

" Misdemeanour " is gone entirely from the Bill ?
