SECTION 358.

Question proposed: " That Section 358 stand part of the Bill."

This takes the place of Section 274 (5), except that a specific fine is now being provided instead of a fine on a daily basis in the Act of 1908.

I know that the Minister has already indicated it to the Committee but I wonder would he mind repeating why we have taken out the clause in the penalty section saying that these are misdemeanours. I suppose they can be charged on summary conviction?

The only reason is that in modern legislation we do not refer to offences as misdemeanours or felonies or otherwise. The draftsman advises us that these are archaic words so far as modern drafting is concerned.

Is it made clear that these offences will be tried summarily?

Yes, it is mentioned later on.

Yes, triable on indictment. You specifically mentioned " indictment ", did you not?
