SECTION 42.

Question proposed: " That Section 42 stand part of the Bill."

There is only one thing I should like to say in regard to Section 42. The Minister may consider that paragraphs (a) and (b) seem difficult and complicated. They make provision for a time when there is an elected President in office and they also make provision for the time when there is not. This is the first Bill that I know of in which specific provisions have been made for the function of President and when there is no elected President in office. It seems a little complicated to me but I am not opposing the section.

Apart from the Defence Forces Acts I do not know of any single provision of this kind. The President, of course, appoints judges, and he has quite a lot of important functions of appointment apart from the commissioning of officers. Is there any necessity for the complexity which is evident in this section ?
