Special Committee Family Law (Maintenance of Spouses and Children) Bill, 1975 debate -
Tuesday, 2 Dec 1975

SECTION 19.

Question proposed : " That section 19 stand part of the Bill."

This is the section referred to earlier.

The penalty section. Does the section as drafted make it clear that the employer as well as the employee can be sued? This should be clear.

Yes. Section 19 clearly applies to the employer as well.

Could the Minister point out where exactly?

Section 12 (1) provides :

" In relation to an attachment of earnings order or an application for such an order, the Court that made the order or to which the application is made may, before or at the hearing or while the order is in force—

. . . (b) order any person appearing to the Court to have the maintenance debtor in his employment to give to the Court, within a specified period, a statement signed by that person . . ."

The employer is also clearly given obligation under section 10.

So we must read, in conjunction with section 19, all of section 10?

Yes, section 19 refers one back.

Question put and agreed to.
