I move amendment No : 6 :
In subsection (1), line 2, after " name " where it firstly occurs to insert " dies or ".
I am not certain that this is not, in fact, covered because I think if a person dies, he does cease to carry on business, obviously. I really want to draw attention to the fact that there does not seem to be anything in this section obliging his personal representative to file the notice.
There is not in the section as it stands. There was in the corresponding section of the 1916 Act. The draftsman thought it better not to impose this responsibility on the personal representatives. I have an open mind about it. I take it the Deputy would not stand on this amendment because it would impose this obligation to notify the Registrar on a dead person.
I was putting it in only to draw attention to the point.
I shall consult with the draftsman again.
