Possibly arising out of the necessity for registration, questions of adjudication as to who owns a particular name or title may arise. The first thing is the furnishing of all relevant information to enable a decision to be made and the second thing is that in case of two people claiming the one business name situations can also arise.
SECTION 9.
Question proposed: " That Section 9 stand part of the Bill ".
If a person is required to furnish information, and refuses, the next step would be for the Minister to initiate a prosecution. The person concerned could then establish whatever he proposes to establish if he wants to avoid the obligation of furnishing particulars. I do not know if that covers the point.
No. On the question of furnishing particulars, I wanted the Minister's power to be wide enough. Is it as wide as the Minister wants it?
I think it is as wide as the Minister would require in any circumstances.
Question put and agreed to.
Sections 10 and 11 agreed to.
