763 Ms McManus asked the Minister for Health and Children if his attention has been drawn to the ruling on 15 December 2003 of the criminal division of the Court of Justice (details supplied), to the fact that the person was recruited under a programme called Operation Whitecoat, and that a deceased associate professor in Trinity College, Dublin, was also recruited under that programme; and if he will make a statement on the matter. I am aware of the case referred to by the Deputy. National tobacco control measures and, in particular, measures to protect the public from exposure to toxic environmental tobacco smoke were not influenced by the research work of the person referred to or his Operation Whitecoat colleagues, living or dead.
