39 Mr. Costello asked the Minister for the Environment, Heritage and Local Government if he has completed his consideration of the implications of the judgment of the Supreme Court given on 29 November 2002 in regard to the possible implications for legislation governing the European and presidential elections; if amendments to the legislation are planned; and if he will make a statement on the matter. Section 32 of the Electoral (Amendment) Bill 2004 deals with expenditure limits for presidential elections in light of the judgment referred to. With regard to European elections, the judgment has already deemed paragraphs 2(a) and 2(c) of the Schedule to the Electoral Act 1997 to be invalid having regard to the provisions of the Constitution; further legislative provision is not considered essential at this stage.
