367 Mr. McGuinness asked the Minister for Finance the Department responsible for the design of the fish pass at Lacken Weir, Kilkenny which was part of the River Nore relief scheme; if the drawing or plans of the pass are available; if a new fish pass is to be constructed; if the existing pass is to be modified; and if he will make a statement on the matter. The Department of Communications, Marine and Natural Resources has responsibility for the specification for the fish pass and OPW has responsibility for the production of the design and the installation of the pass. The final design produced was approved by the Department of Communications, Marine and Natural Resources prior to construction. Copies of the construction drawings can be made available to interested parties on request.

A review of the functioning of the fish pass is currently being carried out by the OPW, the Department of Communications, Marine and Natural Resources and the Southern Regional Fisheries Board. Upon completion of the review, OPW will be in a position to confirm the exact nature of any work required. Preliminary investigations, however, indicate that some modifications to the existing fish pass will resolve the issues associated with the functioning of the pass.
