34 Mr. Quinn asked the Minister for Finance the number of former Dáil Éireann secretaries who are likely to be eligible for a lump-sum pension payout arising from the decision of the Circuit Criminal Court on 3 February 2005 in the case taken by a person (details supplied); the amount likely to be paid out; and if he will make a statement on the matter. As the Deputy is aware, the court case referred to relates to the retirement lump sum of a person who retired in 1997 under an arrangement reached in 1997 for voluntary early retirement. The court held that a lump sum in this case should be paid. The amount involved was €27,687.

I am informed by the Oireachtas Commission that there are up to 51 people in similar circumstances. These will reach age 60 at various stages over many years and may be entitled to retirement lump sums of differing amounts, relating to their length of service, retirement salaries and pay rates applying at the time each lump sum becomes payable.
