212 Mr. F. McGrath asked the Tánaiste and Minister for Health and Children if she will make a statement on the role of the Health Service Executive with regard to the complaint of persons (details supplied); and if the Health Service Executive has a role in resolving this issue. [7846/05]

The Health Act 2004 provided for the Health Service Executive, which was established on 1 January 2005. Under the Act, the executive has the responsibility to manage and deliver, or arrange to be delivered on its behalf, health and personal social services. This includes responsibility for child welfare issues. Accordingly, my Department has requested the chief officer of the Health Service Executive, eastern regional area, to investigate the matter raised and to reply directly to the Deputy.

213 Mr. Bruton asked the Tánaiste and Minister for Health and Children if she has received any report from health agencies about the possibility of retaining facilities (details supplied) in use in an area where there is a huge unmet need; and if she can ensure that all existing patients are properly provided for. The Health Act 2004 provided for the Health Service Executive, which was established on 1 January 2005. Under the Act, the executive has the responsibility to manage and deliver, or arrange to be delivered on its behalf, health and personal social services. This includes responsibility for the provision of health services in Dublin 9. Accordingly, my Department has requested the chief officer for the executive's eastern regional area to investigate the matter raised and to reply directly to the Deputy.
