157 Mr. P. McGrath asked the Tánaiste and Minister for Health and Children the average weekly rate of payment by an old age pensioner who was hospitalised in a publicly funded bed in a nursing home for each year from 1970 to date; and the estimated refund to be paid to persons or their estates, based on those figures and the number of publicly funded nursing home beds available. My Department is studying the Supreme Court judgment in detail and will take on board all the consequences for policy and law arising from the judgment.

The details of a repayment scheme to address the situation following the Supreme Court decision are being finalised and it is only following this that it will be possible to provide information on the estimated refund to be paid overall. My Department has asked the Health Service Executive to provide information on the average weekly rate of payment by an old age pensioner who was hospitalised in a publicly funded bed in a nursing home for each year from 1970 to date. I will reply to the Deputy on receipt of this report.
