400 Mr. Kenny asked the Minister for the Environment, Heritage and Local Government the preventative measures in place to prevent motorcyclists from congregating and moto-racing in an SAC area (details supplied) in County Donegal; and if he will make a statement on the matter. [16900/05]

This site is protected under the European Communities (Natural Habitats) Regulations 1997. Consequently, it is unlawful to engage in any activity which would alter or interfere in any significant way with the natural ecology of the site without prior consultation with my Department. Failure to observe this requirement may result in legal action to have the damaging activities terminated and the site fully restored.

Staff from the national parks and wildlife service of my department have advised the landowners of this and continue to monitor the situation in conjunction with the Garda Síochána. In addition, the matter has been brought to the attention of Donegal County Council for any action which the council deems necessary under the planning Acts. In addition, draft regulations are being finalised within my Department which would provide additional powers to control activities within special areas of conservation, where habitats or species are likely to be damaged by activities, including use of motorcycles or other vehicles.
