41 Mr. Howlin asked the Minister for Justice, Equality and Law Reform if a financial settlement has been offered to members of the McBrearty families in respect of their claim against the State arising from the matters highlighted in the two reports of the Morris tribunal; when the promised apology will be issued; the persons who will be covered by the apology; and if he will make a statement on the matter. View answerI have made clear that an apology is due on behalf of the State to everyone who has been wronged by Garda misconduct in Donegal, and this, of course, includes the McBrearty family. The terms of the apologies will be settled as part of the resolution of the related civil actions currently before the courts.
As regards any offer of a financial settlement of the case currently before the High Court involving Mr. McBrearty Junior, I am legally constrained in what I can say about the detail of any confidential discussions between counsel for the State and counsel for Mr. McBrearty, but I can confirm that there is ongoing communication and discussion between the two legal teams.
