275 Mr. Neville asked the Minister for Agriculture and Food if she will reconsider the payment of a bull premium applied for on 4 November 2004 to a person (details supplied) in County Limerick in view of information forwarded to her Department outlining the special circumstances of the person. In response to a previous parliamentary question concerning this matter, I indicated that as the animals in question were non-CMMS-compliant when they were submitted by the person named for the 2004 special beef premium scheme, premium could not be paid. It is a basic requirement of the scheme that animals be recorded on my Department's CMMS database as being in the herd of the applicant on the date of application for the scheme. I indicated that my Department was not aware of any special circumstances concerning the case.

Subsequently, the person named contacted the Department in writing, outlining the circumstances that led to the animals being non-CMMS-compliant. However, having considered the case further, it has been concluded that the circumstances as outlined are not such as would allow payment for the animals concerned. It is open to the person named to submit an appeal to the Agriculture Appeals Office, should the person named so wish.
