103 Mr. Howlin asked the Tánaiste and Minister for Health and Children the basis on which the State is appealing an award of legal costs, which have already been adjudicated by the Taxing Master, in the compensation tribunal case of a person (details supplied) in County Carlow; and if she will make a statement on the matter. My Department has no knowledge of the case to which the Deputy refers, and has no role in either approving or appealing legal costs to persons who have made claims to the hepatitis C and HIV compensation tribunal. The Department's sole function in relation to legal costs in compensation tribunal cases is to make payment on the instructions of the Office of the Chief State Solicitor.
