View answerAs was stated in the reply on this matter to Deputy Howlin in November 2005, the issue of whether legislation to provide for the creation of a new offence of corporate manslaughter as suggested by the Law Reform Commission in its recent report is not a matter for the Minister for Enterprise, Trade and Employment. The main thrust of the recommendations are at a much wider area of responsibility than that covered by the Department of Enterprise, Trade and Employment and, consequently, the Department does not have a primary function in the matter.
At the time of the launch of the report, the Minister for Enterprise, Trade and Employment, Deputy Martin, made it clear that consideration of the report will take place primarily at Government level by the Minister for Justice, Equality and Law Reform in the context of his main responsibilities for the criminal law system.
