Questions (333)

Joe Sherlock

Question:

388 Mr. Sherlock asked the Minister for Justice, Equality and Law Reform if his attention has been drawn to the fact that the court upheld the constitutionality of law permitting the purchase of ground rents from landlords; if the Ground Rents Bill will be restored to the programme; and when same will happen. As regards any future measures regarding ground rents, the position is that a High Court challenge to the constitutionality of certain provisions of existing ground rents legislation was heard during 2005 and the Court's judgment was given earlier this year. I understand however that the period within which an appeal against that ruling can be taken has not expired and it would not be appropriate therefore to proceed with any proposals for legislative changes at this time.
