Written answers

Section 25 of the Local Government (Planning and Development) Act, 1976 and the equivalent provision of the Planning and Development Act, 2000 (section 45) relate to the acquisition of open spaces by planning authorities, in cases where, following a requirement by the local authority, the owner fails to maintain the land as open space. My Department does not have information on the use of these sections by local authorities and has not issued any advice to planning authorities regarding their use.
