243 Mr. Curran asked the Tánaiste and Minister for Justice, Equality and Law Reform if it is possible for a person (details supplied) to make an application from within this country to have their visa changed from a business visa to a study visa or must they return to Nigeria to make such an application. The person concerned was granted a C Business visa to enter the State for a period of three months. Supporting documentation submitted with the visa application indicated that the purpose of his journey was to source equipment for a business. C Visas are granted for visits of less than 90 days. As a consequence it is not the general policy to extend permission to remain to persons who are admitted initially for a period of 90 days or less on a C Visa, save in very exceptional and unforeseen circumstances.

It is not possible, therefore, for the person concerned to change his permission to remain to that of student conditions. He must leave and apply for the appropriate visa from outside the State should he wish to return. He should include in his new visa application the purpose and duration of his intended stay.
