534 Deputy Finian McGrath asked the Minister for Enterprise, Trade and Employment the person to whom a company (details supplied) can be made accountable for the way they are treating customers; and the reason Comreg and Consumer Affairs do not make them accountable; and if he will advise on this matter. Telecommunication companies like all traders have responsibilities under the Sale of Goods & Supply of Services Act 1980. Consumers who are unhappy with the service provided by the company referred to by the Deputy and who are of the view that the company is not supplying services with due skill, care and diligence as required under the 1980 Act, have the option of pursuing a claim before the Small Claims Court.

The National Consumer Agency (NCA) has certain enforcement functions under the provisions of the 1980 Act. The exercise of these functions is a day to day matter for the NCA and is one in which the Minister has no direct function.
