272 Deputy Ulick Burke asked the Minister for Health and Children the number of bullying cases active within the Health Service Executive for each of the HSE areas; her views on whether in-house investigations are adequate; the number of cases resolved through these processes; the number of cases which have proceeded to outside arbitration; and if she will make a statement on the matter. Under the Health Act 2004, the Health Service Executive has the responsibility to manage and deliver, or arrange to have delivered on its behalf, health and personal social services in a safe and secure setting. This includes responsibility for dealing with any complaints an employee may have concerning his or her working environment. The Executive is therefore the appropriate body to consider the matter raised by the Deputy. My Department has requested the Parliamentary Affairs Division of the Executive to arrange to have the matter investigated and to have a reply issued to the Deputy.

273 Deputy Tom Hayes asked the Minister for Health and Children if the recruitment issues experienced in hiring care assistants to run the newly renovated ten-bed residential service for the mentally infirm (details supplied) in County Tipperary have been resolved; if all newly refurbished units across the country are being delayed in this fashion; and if she will make a statement on the matter. Operational responsibility for the management and delivery of health and personal social services was assigned to the Health Service Executive under the Health Act 2004 and funding for all health services has been provided as part of its overall vote. The Executive, therefore, is the appropriate body to consider the particular case raised by the Deputy. My Department has requested the Parliamentary Affairs Division of the Executive to arrange to have the matter investigated and to have a reply issued directly to the Deputy.
