178 Deputy Seán Sherlock asked the Minister for Social and Family Affairs the grounds on which an appeal of an application for a carer’s allowance was turned down in respect of a person (details supplied) in County Cork; and if he will make a statement on the matter. [17055/10]
View answerI am advised by the Social Welfare Appeals Office that the Appeals Officer, having considered all the available evidence, including that adduced at oral hearing, disallowed the carer's allowance appeal of the person concerned. The Appeals Officer found that whereas he was satisfied that the appellant provides a high level of care to the care recipient he was not satisfied that it has been established that it constitutes full-time care and attention in accordance with relevant Social Welfare Legislation. The Social Welfare Appeals Office functions independently of the Minister for Social and Family Affairs and of the Department and is responsible for determining appeals against decisions on social welfare entitlement.
