View answerUnder the Data Protection Acts 1988 and 2003, individuals have a right of access, subject to limited exemptions, to their personal data irrespective of whether the data is held by a data controller in the private, voluntary or public sectors. Specific rules in relation to the right of access to personal data relating to physical or mental health are set out in the Data Protection (Access Modification) (Health) Regulations 1989.
