380 Deputy Jerry Buttimer asked the Minister for Justice and Equality if he will consider amending legislation to facilitate patients accessing medical records held by private health care facilities in a similar manner to that available through public health care facilities; and if he will make a statement on the matter. Under the Data Protection Acts 1988 and 2003, individuals have a right of access, subject to limited exemptions, to their personal data irrespective of whether the data is held by a data controller in the private, voluntary or public sectors. Specific rules in relation to the right of access to personal data relating to physical or mental health are set out in the Data Protection (Access Modification) (Health) Regulations 1989.
