351 Deputy Barry Cowen asked the Minister for the Environment, Community and Local Government if he will confirm that the Private Residential Tenancies Board has sufficient legal jurisdiction to deal with residential tenancy contracts, or if such contracts should be considered as civil matters; and if he will make a statement on the matter. View answerThe Private Residential Tenancies Board (PRTB) was established under the Residential Tenancies Act 2004. The Act provides the main legislative framework for the private rented residential sector and for the operation of the PRTB. It sets out the obligations of tenants and landlords in the sector and the PRTB is charged with the enforcement of those obligations, as necessary, and the administration of the Act. The Act applies to all dwellings that are the subject of a tenancy, whether oral or in writing or implied, except for the exemptions outlined in section 3(2) of the Act. Matters arising within the exempted categories are dealt with, as necessary, by civil proceedings. All other matters fall to be dealt with by the PRTB.
