416 Deputy John O’Mahony asked the Minister for Agriculture, Food and the Marine when a person (details supplied) in County Mayo will receive their REP scheme payment; and if he will make a statement on the matter. [32108/11]

The person named commenced REPS 3 in October 2006 and received payments for the first four years of the contract. However, a 100% penalty for the amount of €4824.53 was applied in 2008 for the removal of scrub in a habitat. On 19 July 2010, the Agricultural Appeals Office upheld the decision of the Department to impose the penalty and advised the person named of his right of appeal to the Office of the Ombudsman. On 30 March 2011, the Office of the Ombudsman upheld the decision of both the Department and the Agricultural Appeals Office. The final year five payment issued in April 2011 for the amount of €4828.87 and this payment fulfils the contract with the person named under REPS 3.
