215 Deputy Patrick O’Donovan asked the Minister for Agriculture, Food and the Marine, further to Parliamentary Question No. 413 of 8 November 2011, if he will verify that the principle of force majeure has never been invoked with regard to the possibility of re-opening schemes. [34888/11]
View answerAs the EU provisions in regard to force majeure can vary from scheme to scheme, it is not possible to provide a general statement in regard to the application of the principle of force majeure which governs all schemes administered by my Department. However, the current EU provisions in regard to the application of force majeure in the case of on-farm investment schemes which are operated by my Department are clear that this facility is strictly limited to beneficiaries only and, in those cases, that the remedy is the avoidance of partial or full reimbursement of the grant-aid received by the beneficiary.
