188 Deputy Seán Ó Fearghaíl asked the Minister for the Environment, Community and Local Government if a county council may assume to itself the planning duties of a town authority, which has planning authority status, without recourse to the members of the council; if he will outline the formal procedures which should be adhered to in circumstances when the performance of planning authority duties are transferred from one authority to another; and if he will make a statement on the matter. Part 10 of the Local Government Act 2001 provides for agreements between local authorities concerning the discharge of functions. Such agreements could include the procedures for discharge of such functions, as appropriate. Section 85(5) of the Act provides that the making of an agreement by a local authority, in so far as it relates to it, is a function reserved to the members of the authority.
